It seemed to be a mix of fact and opinion, so the source would tell a lot about any bias of the author. That allows us to put it in perspective. I can offer my opinion in person as a state employee about our current political climate, but I can't put it in writing. I will say there is a strong push from a vocal and very conservative minority on many issues, most of which are not in line with the views of most Hoosiers. With state legislators, I can say that they are often seeking input and are willing to listen to views on pending legislation. The problem is that there can be little warning when bills are going to be heard or that they are even proposed in the first place. It takes a little research on the legislative web site but all bills are on the web. A properly timed email can have an influence if it is well written with facts supporting your view. Paid vacation, health insurance, five day work week, time-and-a-half overtime pay, seniority, and many more benefits taken for granted by today's workers were all hard won by unions. If all are to benefit from the contract, all should pay dues. If they don't want to be a member of the union, they don't have to be a member, but they should absolutely have to pay shop fees. I agree that some work rules have gotten out of hand these days, but that sort of thing can be worked out. Unions will be making more and more concessions in this day of a failing economy. The statement addresses the growing number of proposed state and local laws and ordinances regulating the use of cellular telephone and text messaging, inadvertently affecting Amateur Radio mobile communications. In its statement, the Executive Committee urges state and municipal legislators to limit the scope of their proposals, limiting them to devices such as full duplex wireless telephones and related hand-held or portable equipment. Alternately, it suggests that licensed Amateur Radio operation be listed specifically as an exclusion to the proposed regulations. "At the start of each new session, you see a flurry of this type of proposal in state legislatures across the country," said ARRL Regulatory Information Manager Dan Henderson, N1ND. As of February 1, 2009, Henderson said that the ARRL is aware of proposals in 11 states: Georgia, Hawaii Idaho, Illinois, Iowa, Maine, Montana, Texas, Utah, Virginia and Wyoming, as well as several local city or town proposals. "These proposals are usually intended to regulate cellular telephone and text messaging by drivers as a matter of safety but, when they are written in very broad terms, can include Amateur Radio mobile operations in the 'net' they cast," Henderson continued. "The Executive Committee's policy statement gives a good, concise background of the role the Amateur Service plays in public safety and service communications. It also highlights the differences between communications conducted by cellular telephone and those using Amateur Radio. Finally, the statement offers some suggested statutory language for state motor vehicle codes which would protect Amateur Radio mobile operation." The ARRL recognizes that driver inattention is a leading cause of automobile accidents. The policy statement raises the fact that cell phones utilize full duplex communications -- where the user is talking and listening simultaneously. The Executive Committee statement says "Two-way radio use is dissimilar from full-duplex cellular telephone communications because the operator spends little time actually transmitting; the time spent listening is more similar to, and arguably less distracting than listening to a broadcast radio, CD or MP3 player. There are no distinctions to be made between or among Amateur Radio, public safety land mobile, private land mobile or citizen's radio in terms of driver distraction. All are distinguishable from mobile cellular telephone communications in this respect." The ARRL Policy Statement also recognizes the responsibility of the amateur community to conduct its activities in a manner that does not create unsafe operation of their motor vehicle. This bridge works by having an established identity in both networks and is the only recognized acceptable method of allowing IRLP and Echolink users to be part of the same net. Ultimately we expect to have a permanent connection to the Indiana Dept of Homeland Security EOC repeater in Indianapolis connected, but implementation of that is still TBD. It's cycling through each baudrate until you see normal text at your software's set rate. When you see the normal text, then hit the asterisk (*). Local governments have the opportunity to improve their streets while still protecting important Major Moves projects. ? The plan provides money for local road projects. ? In fiscal years 2009 and 2010, municipalities and county governments would receive a total of $500 million for road construction, maintenance and repair from the newly established Local Road Special Projects Fund. ? $250 million in federal highway funding would be placed in the fund from these existing state funds: Surface Transportation Fund, Bridge Fund Equity Bonus Fund. ? $250 million in money generated through the federal stimulus bill would also be placed in the special projects fund for a total of $500 million over the biennium available to Indiana cities, towns and counties for local road projects. As the federal stimulus road dollars contain aggressive timeline restrictions, and the Special Projects Fund also contains timeline restrictions placing difficult challenges before local communities, the State would establish a $20M Community Infrastructure Assistance Fund from unallocated stabilization fund monies to assist local units with technical and engineering expertise to qualify and utilize the federal stimulus money and the Special Project Fund. The plan creates Adult Workforce Retraining Grants. ? Indiana residents who have lost their jobs in the past year due to reductions in the workforce would be eligible for the Adult Workforce Retraining Grants administered by the Department of Workforce Development. ? Out-of-work Hoosiers would be eligible to receive a $3,000-per-year grant for two years to be used at any two- or four-year year institution of higher learning. The plan provides for higher-education construction. ? Under the federal stimulus bill, Indiana will receive money from the Higher Education Modernization, Renovation and Repair Fund. Feticide Deserves a Harsher Sentence The Indiana statute contains hundreds of laws that protect our citizens from unthinkably awful crimes. Sometimes, though, they?re not tough enough. Last spring, during an Indianapolis bank robbery, a pregnant teller was shot in the abdomen, resulting in the death of the twin girls, Katherin and Franchesca, the teller was carrying. Because the twins were only five or six months along in the pregnancy, the suspect may get away with only eight years of prison time for this double feticide when he stands trial in May. Current law provides a scant two to eight years for feticide if the fetus is younger than the age of viability, which most courts determine to be about seven months. Rep. Mike Murphy (R-Indianapolis) and Rep. David Yarde (R-Garrett) have authored HB 1698 to increase the sentence for feticide, or killing a baby in the mother?s womb before it can survive on its own. The bill has been referred to the House Judiciary Committee. The bill provides that violent crimes, such as homicide, battery and sex charges, as well as arson, burglary or dealing illegal drugs, that result in the death of an unborn child could be punished with a sentence equal to the sentence for the violent crime. That sentence would not be susceptible to suspension. In the Senate, Sen. James W. Merritt (R-Indianapolis) has introduced a bill that would make the sentence for feticide equal to that of murder. Both bills need work, discussion and careful deliberation from General Assembly legislators. Let?s hope that next time tragedy strikes, Indiana courts will have the power to demonstrate that the value of unborn lives is no different than the value of humans outside the womb. Let?s hope that tough laws mean criminals think twice before resorting to violence ? especially since violence may have unanticipated consequences. Wolkins Bill Would Create Silver Alert The House Veterans Affairs and Public Safety Committee unanimously passed a bill that would create a Silver Alert for missing older Hoosiers. House Bill 1512 would inform the public and police quickly through the new Indiana Clearinghouse for Information on Missing Children and Missing Endangered Adults. The Silver Alert would use the same response procedures as an Amber Alert for missing children. ?Missing adults are just as serious as a missing child,? said Rep. Dave Wolkins (R-Winona Lake). ?Having a Silver Alert is extremely necessary and would save lives and put families at ease.? Three months ago, Alzheimer?s victim George Brelsford, 82, Warsaw, was reported missing by his daughter after he did not return home from his bowling league. He was found by Vigo County authorities 30 hours later in Terre Haute, more than 200 miles away. ?It is a blessing George was found with no injuries or harm done,? said Rep. Wolkins. ?This has happened too many times to endangered adults, and the search was not always as successful as George?s.? Nine states already have a Silver Alert procedure. Six of 10 people with Alzheimer?s disease will turn up missing, according to statistics. This bill is supported by the AARP, Indiana Alzheimer?s Association, Indiana State Police and the Indiana Broadcasters Association. Current law states local law enforcement must complete a missing person report within five hours of notification. The local law enforcement agency may forward the report to any police department, area broadcaster and the National Crime Information Center?s Missing Persons File. HB 1512 would now have law enforcement agencies first contact the Indiana Clearinghouse for Information on Missing Children and Missing Endangered Adults. From there, information on the missing person and alerts would quickly be transmitted to broadcasters. ?I am happy to have been able to pass this bill into the House,? said Rep. Wolkins. ?This is a civil issue I am glad to see Rep. GiaQuinta (D-Fort Wayne) address. Having the support of the clearinghouse will revolutionize the procedure of a missing person. So will a new TV with a Built in Digital tuner out Perform a Converter Box 73 De Don KA9QJG Jackson Township resident Wayne Weaver said that if his television reception during stormy weather is any sign of the troubles to come, then he is certainly concerned about losing broadcast signal after the nation's analog to digital conversion. Even though Weaver has a large antenna mounted on his roof, he says he still cannot receive a digital signal during bouts of bad weather. "During a heavy rainstorm, either here or directly south of us, I will lose signal. I cannot get channel 5 and I have never been able to get channel 7. My concern is when everything is digital, I'll be without a signal," Weaver said. He said he has contacted Chicago television stations to inquire if they will increase their output or keep it at the same strength as analog, but he has been unable to get an answer and fears the answer will come after conversion. Toni Falvo, vice president of research programming and press at WMAQ in Chicago, which owns and operates NBC5, says the signal strength will not change from what now is being broadcast. "The digital signal we have replicates the analog, so it's just the same strength as the analog," Falvo says. For those in rural areas, like Weaver, and others who may not have rooftop antennas, this may mean problems. "It all depends on the individual and the antenna they have," Falvo said. Dale Kempf, adjunct professor in Valparaiso University's electrical and computer engineering department, agrees and said the problem has to do with the nature of the digital signal versus the analog signal. "With digital broadcasting, there is an error-correcting code built in, so if you receive an error in the signal, but there aren't too many errors, the picture can correct itself. But too many errors in the signal and it can't correct itself, so you won't get a picture at all. With digital broadcast, it's either an all or nothing picture," Kempf said. That means for people like Weaver, they may be left with a black screen. And Kempf knows what that looks like, since he is not only an expert in the field, but also a consumer. "I live about a half mile south of highway (U.S.) 30 in Valparaiso. I have a pretty good antenna and have a converter box and it still depends on the weather if I get a signal or not. Sometimes I have trouble with channel 7's digital broadcast, and have problems with channels 26 and 62," Kempf says. And these are the residents who have rooftop or large digital antennas. For those residents who have been getting by with a snowy or fuzzy but acceptable analog signal picture for the past number of years, chances are slim they will be able to get a digital picture, said Greg Clark, who is in system design and integration with Omni Entertainment in Valparaiso. Although it is difficult for experts to pinpoint who will receive a quality digital signal and who will not, www.tvfool.com does have a listing of the regional stations' digital signal strength. While WMAQ, or channel 5, has a digital broadcast strength of 350 kilowatts, WLS's digital broadcast strength is only 153.6 kilowatts, so weaker channels may not be picked up in rural, wooded areas, especially by set top antennas. "Bottom line is, you have to have good equipment to receive a good picture on the TV. There's just not enough signal strength to go all those miles, especially not to rabbit ears on top of a TV. That will not be good enough to pull in the signal," Clark said. What's the solution? Clark said, "They need a bigger external antenna to pull the signal, and not just an antenna, but an amplifier as well." He also says that the quality of the converter box is an issue. "If it's a digital tuner that costs $40, as much as the coupon, then it's just not the same as a $60 tuner because you get what you pay for. A more expensive tuner has better circuitry that captures the most from the antenna," Clark said. And there is some hope, Clark said, that the current situation may not be reflective of what will come. "Currently broadcasters are sending signals in analog and digital, so the airwaves are crowded with both digital and analog signals. Once the transition occurs, the airwaves will become less crowded with just digital," he said. Unfortunately, for most rural television viewers, the real answer may be to watch and see. According to various news reports, Oklahoma officials credited Amateur Radio operators with spotting the tornadoes and relaying the information to the National Weather Service. ARRL Oklahoma Section Emergency Coordinator Charles Goodson, KC5UEG, told the ARRL that the Southern Oklahoma ARES group (SOARES) and other Amateur Radio operators from the Ardmore area served as SKYWARN storm spotters. "After the tornado passed Lone Grove and Ardmore, several hams went back to the Lone Grove area," Goodson said. "One ham went to the Red Cross building and set up a communication command post from the Red Cross radio room. It was amateur operators who had the first visual contact with the tornadoes. They started reporting the tornado to Neil Mayo, KC5AMX, the Emergency Coordinator for Murray County and our Net control for severe weather events; he in turn reports to the National Weather Service in Norman via Amateur Radio." The town of Lone Grove, population 4600 and located about 100 miles south of Oklahoma City, bore the brunt of the storm, with the Oklahoma Department of Emergency Management (ODEM) reporting eight deaths and more than 100 homes destroyed. Two other tornadoes hit the Oklahoma City metro area and the north-central Oklahoma region late Tuesday. No serious injuries were reported in the Oklahoma City storm, but at least six homes were destroyed and businesses were damaged there, ODEM officials said. ARRL Oklahoma Section Public Information Coordinator Kevin O'Dell, N0IRW, told the ARRL that his Ardmore home survived the tornado, but they are without power, water and other services. Other homes in his neighborhood were completely destroyed. Oklahoma Gas and Electric reported about 6000 customers are currently without power, with 3461 in Lone Grove. Well-known contester Tim Duffy, K3LR, told the ARRL that he lost 40 percent of his home as a tornado blew through his town of Edmond, a suburb of Oklahoma City: "We lost all the doors and windows in the house, all the power, just everything. The damage is amazing. The cell phone system is still 'on tilt' with emergency services taking most of the channels. We're making big progress on getting things sorted out here. We will rebuild and make it better than it was before. With the house in complete disrepair, we'll be staying in a hotel for a while." Duffy said that National Weather Service officials told him that the wind speed at his home was more than 150 MPH. While the family dog, a golden retriever, made it through the storm okay, Duffy said their pet cat is still missing. According to emergency management officials in Edmond, six homes were destroyed in the storm. This storm took many by surprise because even in tornado-prone Oklahoma, February twisters are rare. According to the NWS, since 1950, only 44 twisters have touched down in the state during the month of February. The Lone Grove tornado was the third to cause multiple fatalities in the state since March 2007, when a Panhandle couple became the state's first tornado deaths in almost six years. ==> NCVEC QUESTION POOL COMMITTEE BEGINS WORK ON 2010 TECHNICIAN POOL REVISIONS The National Conference of Volunteer Examiner Coordinators' (NCVEC) Question Pool Committee (QPC) is currently reviewing the Technician class (Element 2) question pool. According to QPC Chairman Rol Anders, K3RA, the review is part of a regular process: "Each question pool is reviewed on a four year rotation. The next Technician class pool will become effective on July 1, 2010." According to QPC Member and ARRL Assistant VEC Manager Perry Green, WY1O, the reason the QPC reviews the three question pools every four years is to ensure that the questions are asking for information relevant to that particular license class. "In the case of the Technician pool, the question set should provide for the new Technician licensee to be able to establish his or her station and operate it legally, courteously and safely. The Technician question pool and exam are intended to be the beginning of the journey into the Amateur Radio Service. It prepares the person for the enjoyment of operating, and that of preparing to learn electronics, the cornerstone of the education needed to obtain the further enjoyment that can come with the higher license classes." Green said that the QPC must rely on members of the Amateur Radio community to suggest questions and answers in a responsible manner to preserve a high level of legitimacy for our radio service, so the NCVEC QPC is seeking input from the amateur community concerning the revision. They are accepting input for new question topics and new questions, as well as suggestions for changes or deletions. Anders said that amateurs may submit questions for the QPC via the NCVEC Web site . If you choose to submit a question for the QPC's consideration, please be sure to observe the following procedure: * Questions must have no more than 210 characters, including spaces, or a maximum of three 70 character lines. * Answers must be no more than 140 characters, including spaces, or two 70 character lines in length. * Each question must be accompanied by four possible answers. The answers may be in any order, but the correct answer must be indicated. * Each question must be accompanied by a resource or Part 97 rule to support the correct answer or explanation of the correct answer. Green said that the most difficult part of writing the questions and answers is creating the incorrect answers. "We try to stay away from 'All of these answers are correct' and 'None of these answers are correct' for some obvious reasons," he said. "It is a more difficult task to find three incorrect answers that are plausible, but are absolutely incorrect!" The current Technician question pool , effective July 1, 2006, will expire on June 30, 2010. The General class question pool is effective July 1, 2007 and is valid through June 30, 2011. The Amateur Extra class pool became effective July 1, 2008 and is valid until June 30, 2012. First started in 1929 as the ARRL International Relay Party, the ARRL DX CW Contest is the longest running contest in Amateur Radio. Stations from all around the world -- from Australia to Zimbabwe -- should be active for this great event that takes place on 160-10 meters (no contest QSOs are permitted on 12, 17, 30 or 60 meters). Stations in the US and Canada work only DX stations (Alaska and Hawaii are considered DX for this contest), and DX stations only work the US and Canada. DX stations will be trying to make as many QSOs with all US states and Canadian provinces as they can. The contest exchange is simple -- US and Canadian stations send a signal report and their state or province, while DX stations send a signal report and the amount of power with which they are transmitting. "If you've never operated a CW contest, now is the time to start," said ARRL Contest Branch Manager Sean Kutzko, KX9X. "You can work a lot of DX with just 100 W and a simple dipole or vertical antenna. If your CW is a little rusty, this event is a great way to get your CW skills back up to snuff and get some new DX countries into your bag. If you live in one of the rarer states, such as Delaware, North Dakota, West Virginia or Wyoming, DX stations from all around the world will be looking for you. This is your opportunity to 'be the rare one!'" After the contest is over and you've had your fill of DX, Kutzko advises that you make sure to submit your QSOs to Logbook of The World (LoTW) : "You can get a lot of your DX QSOs confirmed with little effort, and the instant gratification of having those QSOs count toward your DXCC totals just can't be beat." Logs sent via postal mail must be postmarked no later than 2359 UTC Monday, March 23, 2009. ==> IARU MEMBER-SOCIETIES RATIFY NEW OFFICERS, VOTE TO ADMIT NEW MEMBERS On February 10, International Amateur Radio Union (IARU) Secretary David Sumner, K1ZZ, counted ballots submitted by IARU Member-Societies. Proposals submitted to the Member-Societies in September 2008 (IARU Calendar 187) included the election of a new IARU President and Vice President, and admission of two new Amateur Radio societies to the IARU. Per the IARU Constitution , each Member-Society must submit its vote in writing; late votes will not be counted. According to Sumner, 73 Member-Societies cast votes or abstentions on the proposals; of these votes, 57 affirmative votes are required for the proposal to pass. Proposal Number 241 Proposal Number 241 concerned the ratification of the nomination of Timothy S. Ellam, VE6SH/G4HUA, to serve as President of the IARU for a 5 year term to begin May 9, 2009: Ellam was declared elected, with 72 votes in favor and 1 abstention. Upon his election as the next IARU President, Ellam said he was "very honoured to have been elected as President of IARU and [I] look forward to working with all three Regions and the Member-Societies during my term in office. We no doubt will face many issues in the run up to the 2011 World Radiocommunication Conference (WRC-11), but I look forward to working as a team to meet the challenges ahead. I would like to thank Larry Price, W4RA, for his sterling work with IARU during his term as President. IARU is in a very strong position today as a result of Larry's leadership. His support and friendship to me has also been very helpful in fulfilling my former duties as Vice President." Ellam was a delegate to the 1998 IARU Region 2 Conference and was elected to the Region 2 Executive Committee in 2001, stepping down upon his election to IARU Vice President in 2004. He also served as an IARU Expert Consultant from 2000 until his election as Vice President. First licensed in 1977 as VE6CJR at the age of 16, Ellam credits a visit to the ITU in 1979 and the opportunity to operate 4U1ITU during his student years with contributing to his interest in the organizational side of Amateur Radio. He held executive positions in the Radio Amateurs of Canada (RAC) and one of its predecessor organizations, the Canadian Radio Relay League (CRRL), starting in 1990. Ellam's extensive travel as IARU Vice President has included a particular emphasis on the ITU Development Sector. He is active on the air from his home in Calgary. Professionally, Ellam is a Barrister and Solicitor with the law firm of McCarthy Tetrault LLP. He is a partner in the firm's Calgary, Alberta, and London, UK, offices. Born in England, Ellam emigrated to Canada in 1972 and holds both Canadian and British/EU citizenship. He holds a BA in political science and economics from the University of Calgary and an LLB from the University of Alberta. He is a member of the Law Societies of Alberta and England & Wales, as well as of the International Bar Association. In 2005, Ellam was made a Fellow in International Legal Practice - College of Law of England and Wales, the first Canadian lawyer to be awarded the designation. He is also qualified in the UK as a solicitor/advocate and was recently awarded higher rights qualifications (the right to appear in all courts) in that jurisdiction. His extensive legal experience includes intellectual property and corporate litigation, arbitrations involving communications, technology and energy matters, and utility regulations. Proposal Number 242 Proposal Number 242 concerned the ratification of the nomination of Ole Garpestad, LA2RR, to serve as Vice President of the IARU for a 5 year term beginning on May 9, 2009. Garpestad was declared elected, receiving 73 votes. "Congratulations to Ole Garpestad for his election as Vice President," Ellam said. "I am very pleased to have Ole as part of the officer team and know he will do an excellent job in his new position." Garpestad joined the Norsk Radio Relae Liga (NRRL) -- Norway's IARU Member-Society -- in 1972, one year before he was licensed as LA2RR. His service as an NRRL volunteer includes service as a member of the NRRL Board of Directors from 1981-1992. While on the NRRL Board, Garpestad served as Secretary, ARDF Manager, IARU Liaison Officer. He also served as Chairman of the Second ARDF World Championship's Organizing Committee and as a member of the IARU Region 1 Conference's Organizing Committee for that meeting in Lillehammer in 1999. Garpestad topped off his service to the NRRL Board of Directors when he served as NRRL President from 2000-2002. In 1999, Garpestad was elected to the IARU Region 1 Executive Committee, and was elected Chairman in 2002. He has represented Region 1 on the IARU's Administrative Council since 2001 and has attended IARU conferences in Regions 2 and 3. He has participated in CEPT preparations for WRC-03 and WRC-07, attending both conferences as a Norwegian delegate representing Amateur Radio interests. Garpestad is a telecom and radio engineer working with development, system design and program management of tactical communications systems for Thales Norway AS (formerly Alcatel). He holds an MSc in electronic engineering and radio technology from the Technical University of Norway in Trondheim. Proposal Number 243 Proposal Number 243 concerned the admission of Emirates Amateur Radio Society (EARS) as an IARU Member-Society. The proposal received 72 votes in favor and 1 abstention. Based in Sharjah, EARS was formally authorized by the Ministry of Social Affairs of the United Arab Emirates on February 5, 2008. There are 72 licensed Amateur Radio operators in the UAE; 28 are members of EARS. His Highness Abdulla Faisal Al Qassimi, A61AQ, is EARS President. Yousuf Ahmed Rafee, A61Y, is Vice President. Mohammad Hamza Darwish, A61M, serves as EARS General Secretary and IARU Liaison, and Qabila Shatter Al Bedawi, A61YL, is Treasurer. Proposal Number 244 Proposal Number 244 concerned the admission of Kazakhstan Federation of Radiosports and Radioamateur (KFRR) . The proposal received 73 votes in favor. According to the IARU, KFRR registered with the Ministry of Justice of the Republic of Kazakhstan and holds a general license from that country's Sports Committee, Ministry of Tourism and Sport. On May 17, 2008, KFFR held its first conference. The Chairman of the KFFR is Seitkul Assaubay, UN7BM; KFFR Vice Chairman is Igor Marchenko, UN7BF. Of the 617 licensed amateurs in Kazakhstan, 452 are KFFR members. With the addition of the Emirates Amateur Radio Society and the Kazakhstan Federation of Radiosports and Radioamateur, there are now 162 IARU Member-Societies. ==> JUDGE RULES IN FAVOR OF AMATEUR IN PALMDALE ANTENNA SUPPORT STRUCTURE CASE On Friday, February 6, Los Angeles Superior Court Judge David Yaffe issued a ruling in favor of Alec Zubarau, WB6X, of Palmdale, California, in Zubarau's case against the City of Palmdale . Last year, after Zubarau received a valid building permit from the City to erect an antenna support structure, the City of Palmdale revoked Zubarau's building permit after he had erected the tower. According to Zubarau's attorney, Len Shaffer, WA6QHD, the Court's ruling invalidates the actions of the City in revoking Zubarau's permit and requires the City to allow him to replace the tower. "Zubarau's case has drawn nationwide attention and financial support from the ARRL, Amateur Radio clubs and individual Amateur Radio operators from around the country," said ARRL Southwestern Division Vice Director Marty Woll, N6VI. "Although this ruling does not directly address the City's proposed zoning ordinance amendment, based on the Court's language, it should provide considerable support for those hams attempting to negotiate a more reasonable provision allowing antenna support structures in the Palmdale City Code." According to Woll, the Court also found that "unsubstantiated complaints by neighbors and anecdotal reports of transmissions interfering with other electrical equipment or posing health and safety concerns" did not constitute substantial evidence. Yaffe's ruling stated that Palmdale's ordinance requiring that amateur antennas be compatible with the surrounding neighborhood with respect to visual and other impacts is void, since it may not constitute the minimum practicable regulation as required under the California state statute . The judge further found that the City's decision to eliminate the tower violates the express requirements of California's PRB-1 equivalent statute that was enacted in 2003, but had yet to be used in a court case. "While falling just short of invalidating Palmdale's current antenna ordinance," Woll said, "this language ought to put a damper on the City's Draconian proposed zoning ordinance amendment and its extreme limitations on Amateur Radio antennas. One hopes that the City of Palmdale will think twice in the future about using tactics -- such as the threat of large fines -- to force compliance with an order based on unsubstantiated findings." Shaffer told ARRL that the text of the Yaffe's ruling will be released after the service of notice on the City and expiration of the appeal period. He, Zubarau and Woll thanked the ARRL and the Amateur Radio community for what he called "the tremendous showing of support during this lengthy battle." ==> IEEE TO FORM BALLOTING GROUP ON BPL EMC STANDARD The Institute of Electrical and Electronics Engineers (IEEE) has been developing standards for Broadband over Power Line (BPL) use and deployment. According to ARRL Lab Manager and IEEE member, there are three IEEE standards in progress at this time. The first, P1675 , covers installation and safety practices and should be published soon. The second, P1901 , is focused mostly on BPL protocols and interoperability between various BPL systems. ARRL has no direct interest in either of these standards. The third standard -- P1775 -- covers the electromagnetic compatibility (EMC) aspects of BPL emissions testing and the immunity of BPL systems. ARRL Lab Manager Ed Hare, W1RFI, as a member of the IEEE's P1775 BPL EMC Standards Working Group, has participated in the development of this standard from the very first meeting held in Denver, Colorado in 2004. "The IEEE Working Group developing the standard is heavily dominated by the BPL industry and its electric-utility and EMC testing partners," Hare noted. "The ARRL was the only radiocommunications stakeholder that regularly attended meetings. Although I did make a number of contributions to the standard that were included, most of the major points I made about what was needed in an EMC standard to achieve compatibility with licensed radio services were voted down by the Working Group. The end result does not offer any real protection to Amateur Radio, despite progress made in the industry in that direction elsewhere." Hare said that the major problem with the emissions testing part of this standard is that it offers little more than a parroting of the FCC rules on how to make measurements: "The test methods in this standard are overly complex and incomplete at the same time. By strongly parroting the FCC rules, the standard is promoting regulations that do not serve well to provide good test methods that enable BPL while protecting licensed services." Hare said that the risk to having an international industry standard that relies heavily on FCC regulations will increase the likelihood that these regulations will be adopted by other countries. Hare has prepared a report that outlines other problems he sees in the present draft of the standard. The IEEE has announced that the P1775 standard is ready for ballot. Hare explained that the balloting process is not only a vote, but it is part of the process to develop standards. "Stakeholders that cannot attend the meetings that develop these standards can join the balloting pool," Hare said. "The IEEE requires that 75 percent of the balloting pool vote to approve the standard. Even if it passes, the IEEE requires that an attempt be made to resolve all negative ballots. The ballot is not as much a vote as it is an important part of ensuring that all interests are represented in an IEEE standard." ARRL encourages those with a radio interest to join the IEEE balloting pool prior to February 22, 2009. Many amateurs are IEEE members; if they are also members of the IEEE Standards Association, they are able to ballot on IEEE standards at no cost. Hare reiterated that ARRL is not opposed to the development of BPL standards, but we realize that the best standards include the interests of all stakeholders. "There are a lot of good parts of this standard," Hare explained, "but it is lacking in areas that would make it a useful tool with good test methods and practices that offer significant protection to licensed radio services. Joining the balloting pool is the best way that amateurs can help develop a more useful and inclusive standard." ==> JIM SMITH, VK9NS (SK) Jim Smith, VK9NS (ex-P29JS), of Norfolk Island, Australia, passed away Tuesday, February 10, after a short illness. He was 80. A noted DXer and ARRL member, Smith was #81 on the Islands on the Air (IOTA) Honour Roll . According to Bernie McClenny, W3UR, editor of "The Daily DX", Smith was first licensed in 1947 as VS1BQ in Singapore: "Through the years, Jim operated as CAR (VU4 Nicobar), VS1BQ, DL2TH, HZ1AB, MP4BER, 9V1PR, P29JS, VR4BJ, H44BJ, G3HSR, C21AA, T3KJ, T3AJ, VK9YS, VK9XS, VK9NS, VK0JS/VK9N, 9M8JS, VK0JS, ZL0AAB, ZM7JS, ZL1BUN, T30JS, T1JS, T32JS, T33JS, A35MR, A51JS, S21U, WR1Z, WR1Z/KH9, S21ZA, VK9WW, A35MR/p, A51MOC, VU2JBS, NO1Z/KH1, VK9WW, WR1Z/KH8, H40AB and A52JS, just to name a few." Smith was originally from Leith, Edinburgh, Scotland. McClenny said that in 1980, Smith founded the Heard Island DX Association (HIDXA) . Three years later, along with wife Kirsti, VK9NL, Smith put the rare VK0/H on the air as VK0NS and VK0NL. "Over the years, Jim put on several all time new countries -- as well as many rare ones -- from the Pacific and Asia," McClenny said. "In fact, he took part in the regulations for Amateur Radio in several DXCC entities. When not out on DXpeditions, Jim could usually be found on 14.222 MHz." Mike Tessmer, K9NW/VK9NW, who visited Norfolk Island for a week in November 2004, remembered Smith fondly on the Society of Midwest Contesters' e-mail reflector: "I spent three wonderful afternoons at Jim and Kirsti's house having tea -- coffee in my case -- and discussing all things DX. Jim showed me the old Collins gear he was restoring. I even picked up a few QSL cards from some of his past DXpeditions. Great memories!" In an e-mail to ARRL Membership and Volunteer Services Manager Dave Patton, NN1N, Andy Chesnokov, UA3AB, told how he first met Smith in Bhutan in 2000 while on the A52A DXpedition . "Boy, Jim was quite upset with us operating from 'his territory,'" Chesnokov said. "But we went along quite nicely after few minutes, and he even allowed us to operate his tiny station there. I met him few times after that and he was a true gentleman." Calling him "a serious DXer," McClenny said Smith worked all countries on SSB, Mixed and only missing one on CW. In April 1986 Jim was inducted into the CQ DX Hall of Fame. One of Smith's last big projects was writing his autobiography, "The Old Timer" . Smith is survived by his wife Kirsti, VK9NL, and his four children: Bruce, G3HSR, Stuart, Sheena and Fraser. Sunspot 1012 has been visible the last couple of days, February 11-12. It is down near the Sun's equator, typical for spots from a previous cycle. It's nice to have a sunspot, but it doesn't indicate activity from the new Solar Cycle 24, which has been so eerily quiet. Sunspot numbers for February 5-11 were 0, 0, 0, 0, 0, 0 and 11 with a mean of 1.6. The 10.7 cm flux was 70.1, 70.1, 71.1, 71.2, 70.7, 67.6 and 70.3 with a mean of 70.2. The estimated planetary A indices were 7, 2, 3, 4, 4, 3 and 5 with a mean of 4. The estimated mid-latitude A indices were 6, 1, 1, 0, 0, 0 and 2 with a mean of 1.4.. According to W1AW Station Manager Joe Carcia, NJ1Q, there has been what he called "increasing activity" near the current bulletin frequency of 1817.5 kHz. "In order to reduce the possibility of interference, W1AW will move to 1802.5 kHz," Carcia said. * K5D Is On the Air!: Due to some heavy winds that delayed helicopter relays onto Desecheo Island, the K5D DXpedition got off to a late start. But according to reports received by the ARRL, as of around 12 noon (EST) on February 13, operators on the island are QRV on 17 and 20 meters; the team will be running CW, SSB and RTTY on 160-6 meters. The DXpedition, headed by Bob Allphin, K4UEE, and Glenn Johnson, W0GJ, is expected to be on Desecheo until February 26. Desecheo Island currently sits at #7 on DX Magazine's Most Wanted list; the island is the second most-wanted DXCC entity in Asia and third most-wanted in Europe. Desecheo is a small uninhabited island in the Mona Passage, 14 miles off the west coast of Puerto Rico. Although specific funding requests from public-safety communications groups aren?t included in the bill, billions of dollars of funding in the legislation potentially could be used to purchase mission-critical communications equipment. The bill allocates $4 billion ? $13.8 billion for local public-safety spending and another several billion dollars for projects of interest to public safety, according to a report from government-focused consultancy Galain Solutions. ?The large span between the minimum of $4 billion and the maximum of $13.8 billion is due to questions over how the states will spend a portion of their proceeds from the State Fiscal Stabilization Fund,? the report said. The total stabilization fund is $53.6 billion, and 18.2 percent of that can be spent on ?public-safety and other government services.? Local and state leaders have public-safety communications projects on their radar for the State Fiscal Stabilization Fund proceeds, according to wish lists published by state and local governments prior to the passage of the bill. The wish lists included radio and 9-1-1 systems, CAD, records management and automated notification systems, in addition to IT enhancement, gunshot location systems, fire and police training facilities and construction of public-safety management facilities. ?Wish lists will need to be modified once governors declare their preferences and processes for spending the money,? the Galain report said. The bill allocates $1 billion for the Community-Oriented Policing Services (COPS) grant program for distribution to state and local law-enforcement agencies. COPS funding has been declining in recent years after peaking at $1.4 billion in fiscal-year (FY) 1996. In the past, COPS money has been used to hire new police officers but also for technology, including automated notification systems, geographic information systems (GIS), CAD and 9-1-1 systems. In addition, the new bill provides for $880 million for local law enforcement or related programs. That money includes $225 million for state and local law enforcement assistance to Indian tribes; $225 million to improve criminal justice systems, assist crime victims and mentor youth; and $30 million for southern border and drug-trafficking areas. The new law also includes $560 million for the Assistance to Firefighters Grant (AFG) program to build new or upgrade fire facilities. The bill also includes $74 billion in funds for broadband services. The National Telecommunications and Information Administration (NTIA) will distribute nearly $4 billion of the broadband allocation as grants. All grants must be awarded by the end of FY 2010. Applicants for grants can be state/local governments or Indian tribes, nonprofit organizations or ?any other entity,? including broadband service or infrastructure providers. About $2.5 billion in loans will also be available through the Department of Agriculture?s Rural Utilities Service (RUS). The FCC is charged with creating a national broadband plan that makes recommendations to Congress on how to ensure the universal adoption of affordable broadband services. NTIA also will develop and maintain a broadband inventory map of current broadband deployments across the country. "I am confident the stimulus bill will provide grant money or contracts specific to public-safety communications. The usual groundswell of local agencies know what technologies they may need; it?s the ability to fund these projects that?s always in question," said Rob Funk, a senior analyst with market research firm Input. "Those in need have kept a strict eye on this bill." Utilities Telecom Council (UTC) officials said the organization was pleased with the bill?s focus on smart grids, especially the enlargement and funding of demonstration projects and matching grants from the 2007 Energy Independence and Security Act. ?Utilities are engaged in a mammoth undertaking to upgrade their infrastructure and add the intelligence that will enable more efficient energy production, delivery and consumption,? said Jill Lyon, UTC vice president and general council. ?The smart grid will be greatly dependent on communications and IT networks already in place, as well as their expansion and interconnection over time. The stimulus package funding will allow these projects to go forward more quickly.? Specific Requests Omitted Although the bill doesn?t include allocations specific to wireless E9-1-1 as requested by the National Emergency Number Association (NENA), the association said it ?worked hard to ensure the inclusion of language in the bill recognizing the need for access to broadband networks for public-safety answering points (PSAPs) and emergency response entities, as well as the services and applications enabled by broadband networks.? ?We are hopeful that NTIA and RUS will take advantage of the opportunity to enable improved access to and use of high-speed broadband networks, both wired and wireless, for emergency-response agencies,? said Patrick Halley, NENA government affairs director. The next step in the process will be to reach out to the federal agencies administering the broadband grant/loan programs to make sure the rules effectively enable 9-1-1/emergency communications access to and use of broadband networks, Halley said. The Public Safety Spectrum Trust (PSST) had requested $15 billion to build a nationwide 700 MHz public-safety broadband network. The Association of Public-Safety Communications Officials (APCO) International also supported federal funding for the network. ?We are pleased that the grant program included in the bill can be applied to the deployment of broadband technologies by public-safety agencies and urge the administration to include more specific programs that benefit public safety as the package is implemented,? said George S. Rice, APCO executive director. Under its provisions, when a disaster disrupts normal telecommunications systems in a given area, the FCC may declare a temporary communication emergency that sets forth any special conditions and special rules stations must observe while it's in effect. The policy clarifies that the FCC has authority to issue ECDs only for communication emergencies and not on the basis of anticipated emergencies. It also tightens up the requirements to request an ECD. The policy calls for VHF and UHF Amateur Service channels to receive preference for ECDs. Requests may indicate a specific repeater system, subject to permission from the repeater's licensee or trustee. It's called TextGateway, and in a nutshell it plugs into your computer soundcard and constantly monitors a frequency listening for DTMF tones. If it detects a pre-set string of DTMF tones, it will automatically send a "canned" e-mail message to any group of addresses that you have specified in advance. For example, an ARES official could set this up on a 2 meter radio that was monitoring the county repeater. The computer running the software would need to be connected to an "always on" broadband Internet connection. For days or weeks, the program would detect nothing. But then one afternoon, while an ARES op is at work, he is informed of a train derailment. The op learns that police are evacuating a three square mile area, and opening shelters. Charlie Cropper lived to help others. His selfless acts are his legacy. Cropper died Tuesday morning at St. Joseph Hospital with his wife, Terri, by his side. It marked the end of his yearlong battle with lung cancer. He was 62. ?What a gentleman he was,? said Tammy Lively, Cropper?s radio co-host and friend. ?He never had a bad thing to say about anyone,? said Lively, who worked alongside Cropper for the past 17 years. ?He was one of the kindest, gentlest men I?ve ever known. ?We?re grateful that he?s out of pain,? Lively said of Cropper?s passing. ?It was a blessing for him, but it?s going to be a tough time for the rest of us.? Cropper and the late Dick Bronson founded We Care. Thirty-six years later, it?s grown to become the community?s leading fundraiser and even one of the largest in the country. All because Bronson and Cropper wanted a way to help those in need during the holidays. Under Cropper?s leadership, the charity gained national attention and helped thousands each year. With a weak voice, Cropper broadcast his last We Care telethon auction this past Christmas. ?This is such a good organization, they haven?t needed me much,? Cropper said in December after reading the memorial gifts to kick-off the three-day telethon. ?His level of caring for others was unbelievable,? said Lively. ?He was a selfless man who loved his community.? Craig Dunn, a friend of Cropper?s for 20 years, said he never met a person with Cropper?s passion for helping others. ?Very few people leave a footprint as large as he has in the terms of lives he?s touched through his community service,? said Dunn. ?A lot of people take out of community throughout their years without ever giving anything back. Charlie was the exception.? The Boy Scouts of America (BSA) has updated the requirements needed to earn the Radio merit badge. The new requirements became effective with the publication of Boy Scout Requirements 2009. While no new content has been added to the program, the new merit badge pamphlet features lots of new information -- including color pictures and updated charts and text -- that reflects the changes in the Amateur Radio Service since the last pamphlet update in 2002. Approximately 4000 Radio merit badges are earned each year. According to ARRL ad hoc Scouting Committee member Larry Wolfgang, WR1B, the new Radio Merit Badge pamphlet had been in the works for some time. "BSA has been replacing all merit badge pamphlets with new booklets using color graphics and more modern presentations," he said. "With attractive color photos and clear text explanations of the requirements, the new merit badge pamphlet is a pleasure for the Scouts to read. The new text is due in large part to the efforts of longtime Radio Merit Badge Counselor and K2BSA National Jamboree Staff member Mike Brown, WB2JWD. I am looking forward to using the new pamphlet to teach Radio merit badge at our Council's Merit-Badge-O-Ree this spring, and to having a supply of the new books available for Scouts during the 2009 summer camp season." Wolfgang said that the requirements for the badge have been shifted around: "The old Part 4 of Requirement 7(b) Broadcast Radio was pulled out and placed in the main body of the requirements as Requirement 8. In addition, the old Requirement 8 (to visit a radio installation and discuss what types of equipment, how it was used, what types of licenses are required to operate and maintain the equipment, and the purpose of the station) was moved up to Requirement 7, so that now the three options appear as Requirement 9. By Sandra Wendelken, Editor In addition to giving consumers more time to prepare, the law that passed earlier this month delaying the digital TV (DTV) transition until June 12 has impacted public-safety licensees who were preparing to use the 700 MHz spectrum for mission-critical communications systems beginning Feb. 17. ?The language of Senate Bill 352 adversely affects any 700 MHz licensee that must protect television stations from interference,? said Charles Bryson, a director at RCC Consultants. Prince George?s County, Md., had planned to begin installing and optimizing a new $76 million Motorola-supplied Project 25 (P25) X2 TDMA 700 MHz simulcast system Feb. 17 and finalize coverage testing by Oct. 1. However, the DTV Delay Act means acceptance of the new system will be pushed back until spring 2010. The county has to work around two TV channels still on the air. Channel 62 will go off the air April 1, but channel 67 will continue analog broadcasting until June. ?The digital TV delay has the potential to delay us until April 2010,? said Wayne McBride, deputy director of the Office of Homeland Security in Prince George?s County. ?There are some technical workarounds that we think may work, but we still have the law to worry about. We are working with the FCC.? McBride said the county will now begin testing May 27. The 21-site system was funded with $62 million in local tax money and $10 million in state and federal grants. All county agencies and 23 local municipal law-enforcement agencies will operate on the mostly voice system, McBride said. Lake County, Fla., will have to delay testing and launch of its new three-zone simulcast system until after June 12 because of the new DTV law. ?We simply can?t move forward or go on the air without the 700 channels,? said Gregory Holcomb, contract counterintelligence officer with Lake County Department of Public Safety. The county?s original timeline was Feb. 17 to begin testing, with a go-live date of April 6. Testing will now begin June 12 with a launch date of around July 20, Holcomb said. Three TV stations affected Lake County?s ability to use channels. Two of the three went digital Feb. 17 as planned, but the third station decided to remain on its 700 MHz spectrum, preventing the county?s testing or use of the spectrum until June 12. The county?s $32 million P25 system includes 18 sites with a mixture of 700 MHz narrowband and 821 MHz voice channels. The system, supplied by Motorola, encompasses 3,000 subscribers and users including sheriff, fire/EMS, the Villages retirement community that spans three counties, and all 14 municipal jurisdictions within Lake County. Spalding County, Ga., originally was going to begin testing at the end of February on National Public Safety Planning Advisory Committee (NPSPAC) frequencies. ?That is not what will happen now,? said Steve Macke, a consultant working on the Spalding network. ?Now they will deploy the new system on the old frequencies and have to reband whenever channel 69 comes off the air. This will cost about $500,000 more due to the issues of tower-top amplifiers and combiners and reprogramming radios.? The county is implementing a new Tyco Electronics Wireless Systems P25 seven-site 7-channel simulcast system with 900 subscribers. The sunspot number for February 24-26 was 12, 14 and 12. Today's number will likely be 0. In a few weeks is the Vernal Equinox -- the first day of Spring in the Northern Hemisphere -- on March 20, 2009 at 1144z. Areas north and south of the equator will be bathed in an equal amount of Sun, and this is always a good time for HF propagation. Using one of the popular propagation programs to predict a path from California to Australia using an average sunspot number of 12, on 15 meters on January 20, there was a good chance of an opening from 2130-0100z, with an excellent chance within that period, at 2330-0030z. On March 20 using the same numbers, the chances of propagation look excellent from 2200-0230z, with the band perhaps opening at 2130z and shutting down at 0330z. This gives us an illustration of propagation changing with the season. Another example would be Dallas to Brazil. On January 20 on 20 meters the band would probably be open from 1800-2300z, with signals gradually increasing about 12 dB over that period. On March 20 a likely 20 meter opening would be from 1830-0230z, with signals increasing 16 dB over that period, and rising faster as well. Geomagnetic activity has been very quiet for a long time now, and this is expected to continue. NOAA and the U.S. Air Force predict a planetary A index of 5 over the next two weeks, with minor exceptions. On March 3 the A index may rise to 8. Geophysical Institute Prague predicts quiet conditions February 28 through March 2, quiet to unsettled March 3-4, then back to quiet on March 5. The predicted quiet conditions should be good for the CQ 160-Meter SSB DX Contest this weekend. Mike Schaffer, KA4JAW lives in West Central Florida, and enjoys observing sporadic-E propagation on broadcast television. His local Channel 2 station, WEDU, ceased analog transmissions recently, eliminating co-channel interference with Channel 3. On Sunday, February 22 just after 2300z Mike noticed a wrestling match on Channel 3, and shortly after a logo appeared for TGV, a broadcaster in Guatemala City (see http://www.canal3.com.gt/). The station is over 1,000 miles away. Joaquin Montoya, EA2CCG in Spain reported good conditions over the past few days during the brief sunspot appearance. On February 25, 2100-2130z he worked a number of states in the Western United States including one in Montana while he was mobile on 20 meters. He could hear K5D, and earlier that day he worked K5D on 17 meters and 6V7P in Senegal as well. An Alaskan newspaper this week ran a story about subdued aurora due to low solar activity.
